Nova lei obriga câmaras a delegar competências e, em Gondomar, 41% dos meios vão passar para as juntas
Houve uma descentralização administrativa no seguimento da lei 75, de 12 de setembro de 2013. A mesma lei, entrou em funcionamento no dia a seguir às eleições e as Câmaras e as Juntas tiveram 180 dias – a contar após a tomada de posse das assembleias municipais – para estabelecer os chamados “acordos de execução”.
Para Nuno Fonseca, presidente da Junta de Freguesia neste momento há agora uma “lei que trata todos por igual. Somos todos freguesias e município”.
Com os acordos de execução – obrigatórios e que só podem ser negociados uma vez – as Câmaras têm que delegar às Juntas de Freguesia várias competências, a menos que as mesmas não tenham condições de as receber. Não é o caso de Rio Tinto. Nuno Fonseca explicou ao Vivacidade que a dimensão da freguesia tem que agora fazer-se valer com as responsabilidades que pode arrecadar também. “Uma junta como Rio Tinto tem que ter capacidade e competência para receber tudo e mais alguma coisa”, comentou. Na prática, em Rio Tinto por exemplo, a Junta ficará responsável pela manutenção de espaços verdes, limpeza de vias e espaços públicos, reparar e substituir mobiliário urbano, manutenção de feiras e mercados, realização de pequenas reparações em estabelecimentos pré-escolares, entre outras coisas.A Câmara e as Juntas e Uniões terão que definir quais os meios que estavam adstritos a essas competências e esses meios têm que passar para as freguesias. Isso representa, no caso de Gondomar, a transferência de várias centenas de milhares de euros para as Juntas e Uniões de Freguesia mas não só. “É provável que haja transferências financeiras, humanas e materiais”, referiu Nuno Fonseca. “Depois temos licenças novas – como as de ruído, por exemplo – que passam diretamente das Câmaras para as juntas também”, acrescenta o autarca.
Na União de Freguesias de Fânzeres e S. Pedro da Cova, o presidente Daniel Vieira, admitiu ao Vivacidade que já existiram “duas reuniões com o presidente da Câmara”.
“Aquilo que pensamos é que – tendo em conta quer o estudo aprofundado daquilo que a Câmara gastava com estas competências quer a análise rigorosa das Juntas de Freguesia – é preciso haver um rigor na transferência destas competências para cada uma das Juntas de Freguesia”, esclareceu Daniel Vieira aproveitou por concordar com as transferências. “As freguesias podem executar melhor as tarefas do que os municípios”, disse.
Os contratos inter-administrativos [antigos protocolos de delegação de competências] continuarão, contudo, a existir.
